1. Service Description

AmaxClaw provides AI-powered creative companion services, including but not limited to AI-generated content, conversational interactions, personalized recommendations, and related tools. The Service is designed for creative expression, companionship, and entertainment purposes.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.

2. Account Registration

To access certain features, you must create an account. When registering, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity under your account
• Not share your account with others or create multiple accounts

You must be at least 18 years old to create an account. If you are under 18, you must have the consent of a parent or legal guardian.

3. Subscription & Payments

AmaxClaw offers both free and paid subscription plans. By purchasing a paid plan, you agree to the following:

• Subscription fees are billed in advance on a recurring basis (monthly or annually) as indicated at the time of purchase
• All fees are non-refundable unless required by applicable law or stated in our refund policy
• We may change pricing with at least 30 days' notice; continued use after the effective date constitutes acceptance
• You are responsible for any applicable taxes
• Free trial periods, if offered, will convert to paid subscriptions at the end of the trial unless cancelled

4. User Content & Conduct

You retain ownership of any content you submit, upload, or create through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process it solely for providing and improving the Service.

You agree not to:

• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Use the Service to harass, impersonate, or harm others
• Attempt to reverse-engineer, decompile, or extract the underlying models or algorithms
• Use automated tools (bots, scrapers) to access the Service without authorization
• Share, resell, or redistribute access to paid features
• Use the Service for any purpose that violates applicable law

5. AI-Generated Content

The Service utilizes artificial intelligence to generate text, images, and other outputs. Regarding AI-generated content, please note:

• AI outputs may not always be accurate, complete, or appropriate — they should not be relied upon as professional, medical, legal, or financial advice
• We do not guarantee the uniqueness or originality of AI-generated content
• You are responsible for reviewing and verifying any AI-generated content before use
• AI models may produce different outputs for the same input at different times
• We continuously improve our models but cannot guarantee uninterrupted or error-free performance

Subject to these Terms, you may use AI-generated content for personal and commercial purposes. However, you may not claim that AI-generated content was created by a human, where such misrepresentation is prohibited by law.

6. Intellectual Property

The Service, including its design, code, models, branding, and documentation, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.

AmaxClaw, its logo, and associated marks are trademarks of AmaxClaw. Nothing in these Terms grants you a right to use our trademarks without permission.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or free of errors, viruses, or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMAXCLAW AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total aggregate liability to you for all claims arising from the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.

9. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service, other users, or third parties. Upon termination:

• Your right to access the Service ceases immediately
• We may delete your account data after a reasonable retention period
• Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and dispute resolution) will remain in effect

You may also delete your account at any time through your account settings.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AmaxClaw is incorporated, without regard to its conflict of law principles.

Any disputes arising from these Terms or the Service shall first be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
